The State of California has until Sept. 11 to challenge the court ruling striking down Proposition 8, however the Governor and Attorney General have both said that they don’t intend to appeal the ruling.

And yesterday, the 3rd District Court of Appeal denied a conservative legal group’s attempt to force them to do so.  They will now turn to the California Supreme Court, according to a report via the Associated Press.

Chief U.S. District Judge Vaughn Walker struck down Proposition 8 as unconstitutional last month and noted in his ruling that the proponents of Proposition 8 would face a big hurdle in fighting to uphold the law as they likely lacked the required standing in Federal courts needed to do so.

Pressing the State of California to do so might close up that hole in their strategy to some degree.
